Unfortunately
there are times in agribusiness when not everything goes to plan.
At these times, losses can be incurred from third parties as a result
of chemical drift, incorrect chemical usage (type and/or rate), poor
sowing technique (e.g. too deep), failure of equipment, fire damage,
unintended grazing by stock and many other causes. IMAG has
expertise in the calculation of quantum of loss in such
circumstances. As such, we are often employed by farmers
interested in knowing the extent of any losses they may have incurred,
or have been accused of causing.
In situations where legal action has been instigated, we are regularly
engaged by legal firms wishing to understand the issues involved and
the quantum of any loss. We provide expert witness advice and
review the case put forward by opposition parties. IMAG fully
understands and abides by the Expert Witness Code of Conduct.
There are many issues that need examination in most legal cases.
Where appropriate, IMAG utilises soil testing, plant tissue analysis,
plant density counts, GPS-based area determination, digital
photography, aerial photograph interpretation, gross margin
calculations (using relevant financial and physical data) and any other
relevant objective measurement techniques. A critical aspect of
many disputes is whether any effort was made, or could be made, to
mitigate and loss. This forms an important component of many loss
calculations.
